01About these terms

These terms apply to every product and service sold under the Zali POS brand. Zali POS is a product of Nomad Studio SA (Pty) Ltd, a private company registered in South Africa ("we", "us"). Zali POS is a trading name, not a separate legal entity.

By ordering hardware, creating a merchant account or using the ZALIPOS software, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

02Your merchant account

You must give us accurate business and banking details, and keep them up to date. We verify every merchant before card payments are switched on, as required by our acquiring bank and the card schemes.

• Keep your login details and staff PINs private.
• Tell us straight away if you think your account has been used without permission.
• You are responsible for the actions of staff you give access to.

03Buying and renting hardware

Hardware bought outright becomes yours once paid in full. Rented hardware remains our property for the rental term; you must look after it and return it when the rental ends.

• Rental fees are quoted in writing and billed monthly in advance.
• Swap-outs for faulty rented units are included, within 48 hours where we can deliver.
• Loss, theft or damage beyond fair wear and tear on rented units is charged at replacement cost.

04Card payments and payouts

We process card payments through our acquiring partners. Settlement is paid to your nominated South African bank account at the payout times shown on our pricing page, less our fees.

• Your card rate tier is reviewed on the first day of each month using your previous three months of card sales.
• We may hold a payout where a transaction looks fraudulent or is disputed, and will tell you why.
• Chargebacks raised by cardholders are handled under card scheme rules; you must provide proof of sale when asked.

05Software plans

The core till is included with every Zali machine. Paid plans add features and are billed monthly or yearly in advance. You may cancel a paid plan at any time; it stays active until the end of the billing period.

06Fees and VAT

All prices on our website exclude VAT unless stated otherwise. We may change our fees on 30 days written notice. Card rates never change mid-month.

07Acceptable use

You may not use Zali POS to sell illegal goods or services, to process payments on behalf of another business, or in any way that breaks card scheme rules or South African law. We may suspend an account that does.

08Liability

Nothing in these terms limits rights you have under the Consumer Protection Act 68 of 2008 where it applies to you. Otherwise, our total liability to you in any 12-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential loss.

09Ending the agreement

You may close your account at any time. We may end the agreement on 30 days notice, or immediately if you seriously breach these terms. Rented hardware must be returned within 14 days of the agreement ending.

10Governing law and contact
